Online vouchers
1. General
By purchasing an online voucher the customer recognises the following conditions of use and acknowledges the following description of the services provided. Any provisions deviating from these are only valid if explicitly agreed by both parties in writing.
2. Conclusion of contract, payment and delivery
The online vouchers offered through the website matterhornparadise.ch represent a non-binding, no-liability offer. The prices shown are given in Swiss francs, inclusive of 8.1% VAT. An online order for a voucher constitutes a binding purchase agreement. Vouchers will be dispatched by Zermatt Bergbahnen AG on receipt of payment of the sum owed as a result of completion of the purchase agreement. Once purchased, vouchers may be printed off by the customer at no cost. Alternatively, vouchers may be sent by post if the customer so wishes. This option entails a delivery charge. No liability can be accepted for any delays resulting from postal delivery. 3. Vouchers
It should be noted that the online vouchers are issued to the customer by Zermatt Bergbahnen AG with a forgery-proof code. As customers can print off their own voucher it is theoretically possible to make numerous copies, but only one print has validity and can be redeemed. The first voucher to be redeemed is considered as the original and will be debited by Zermatt Bergbahnen AG immediately when redeemed. The emergence of any copies with the same code will then constitute an act of fraud which may result in prosecution. As a voucher may be transferred or given to another person as a gift, Zermatt Bergbahnen AG is neither obliged nor able to check the user’s right of ownership.
Vouchers will not be replaced if lost. Vouchers may not be returned in exchange for their cash value. If the value of the voucher is greater than the price of the service used, a new voucher will be generated in the amount of the residual value. The user does not have the right to claim a cash payment for the outstanding value of the voucher. The service provided may differ slightly from that described in the voucher but must not represent any significant reduction in value for the customer. If Zermatt Bergbahnen AG is for any reason unable to perform the service as stated in the voucher, the voucher will expire without compensation.
4. Validity
Monetary vouchers have no expiry date and may be redeemed at any time. All other vouchers may be redeemed on prior request and subject to availability, and are valid for one year from the date of issue.
5. Cash payment, accounting
It is not possible to exchange the voucher for a cash payment, i.e. the monetary value represented by it. It is only possible to issue an appropriate VAT invoice with the relevant tax identification at the time the voucher is redeemed and the actual service performed.
6. Security guarantee, data protection
Your security is our top priority. Therefore, when you pay by credit card, data such as your credit card number, name and address is only transferred via certified payment providers using their protected SSL connection and in compliance with PCI guidelines. This means that no unauthorized person can read data you enter during the online transaction. We also apply a number of additional security measures to further increase security in the voucher store. Your details are processed by our automated systems. Through our General Terms and Conditions the customer agrees to receive marketing information from Zermatt Bergbahnen AG. This data is not forwarded to third parties.
7. Exchange, right to cancel
Vouchers which do not meet the customer’s expectations may be returned to us within 14 days of dispatch at the customer’s own expense. Zermatt Bergbahnen AG must receive the written cancellation statement within 14 days. There is no right of cancellation if the customer has made any use of the service within the cancellation period. This right to return is only valid for customers who may be classified as users. Zermatt Bergbahnen AG cannot replace vouchers in the event of loss, theft or devaluation.
8. Court of jurisdiction
All contractual relationships are subject exclusively to Swiss law. The court of jurisdiction is Visp.
